By accessing, browsing, or using this website (the “Site”), or interacting with our service portals (including CasperPortal.com), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not access or use the Site.

These Terms, together with our Privacy Policy and any specific "Notice at Collection" provided during service inquiries, govern your use of the Site. These materials are protected by applicable intellectual property and data governance laws effective as of 2026.

1. Eligibility and Security Obligations

Eligibility: By using the Site, you represent and warrant that you are at least 18 years of age and legally capable of entering into binding agreements. If you are accessing the Site on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

User Security: In alignment with 2026 "Reasonable Security" standards, users must implement multi-factor authentication (MFA) where available. You agree to notify us immediately of any unauthorized access to your account or security breach related to our services.

2. A2P 10DLC Compliance and Messaging Consent

By providing your phone number to CasperB2B, you explicitly consent to receive Application-to-Person (A2P) text messages, including but not limited to, account alerts, marketing notifications, and service updates.

  • Opt-In: Consent is obtained via webform, keyword, or written agreement. Messaging frequency varies based on your interaction with CasperPortal.
  • Opt-Out: You may reply "STOP" at any time to unsubscribe from SMS communications. Reply "HELP" for assistance.
  • Carrier Fees: Message and data rates may apply. CasperB2B is not responsible for delays or failures in delivery caused by mobile carriers.
  • Prohibited Content: Users of CasperPortal are strictly prohibited from sending SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco/Vape) content or any messaging that violates TCPA or CTIA guidelines.

3. AI Transparency and Automated Decision-Making

As of January 2026, our marketing automation tools utilize Automated Decision-Making Technology (ADMT) to enhance lead nurturing.

  • Logic: Our systems categorize leads based on behavioral metadata and interaction frequency.
  • Right to Human Review: Users have the right to contest significant decisions made solely by automated processing and may request a human review of such determinations.

4. Intellectual Property and Service Deliverables

All content and logos are the property of CasperB2B. For clients utilizing our "Video Marketing" or "Stationery Design" services, ownership of specific deliverables is governed by the individual Statement of Work (SOW). Unless otherwise stated, CasperB2B retains ownership of all underlying methodologies and software code.

5. Disclaimer of Warranties and "Reasonable Security"

The Site and services are provided on an “as-is” basis. While CasperB2B maintains a comprehensive cybersecurity program, we do not warrant that the Site will be 100% secure or error-free. For Security Operation Center (SOC) services, our liability is limited to the "Shared Responsibility" model defined in your service agreement.

6. Limitation of Liability

To the maximum extent permitted by 2026 law, CasperB2B’s liability for damages arising from service defects is limited to the amount paid for the service in the six months preceding the incident. We are not liable for business interruptions resulting from third-party infrastructure failures beyond our "Reasonable Security" controls.

7. Subscription and Cancellation (Click-to-Cancel)

For CasperPortal subscriptions ($297/month):

  • 14-Day Trial: You will be notified 48 hours before your trial expires and your first charge occurs.
  • Two-Click Cancellation: In compliance with 2026 "Click-to-Cancel" mandates, you may terminate your subscription through a process within your dashboard that is as simple as the initial sign-up.
  • Refunds: Refund requests for incomplete or "blocked" orders must be submitted to [email protected].

8. Complaint and Dispute Resolution

Formal Complaint Procedure: If you believe CasperB2B has violated these Terms or your statutory rights, you must first submit a formal complaint to [email protected]. We will provide a written response within 15 business days.

Mandatory Mediation: Before filing any legal action, both parties agree to engage in good-faith mediation for a period of at least 30 days. This requirement does not apply to the collection of unpaid fees or the protection of intellectual property rights.

9. Governing Law and State Data Privacy Acts

These Terms are governed by the laws of the State of New Hampshire. For residents of Massachusetts, Indiana, Kentucky, and Rhode Island, we acknowledge your specific statutory rights under the 2026 Data Privacy Acts. Disputes will be resolved in the state or federal courts of New Hampshire.

10. Referral Reward Program

  • Eligibility: Referrers must have obtained prior consent from the candidate to share their contact information.
  • Reward: A $100 reward is granted after the candidate completes 90 days of continuous employment.
